Most MEP claims are not lost in arbitration. They are lost on the project, months earlier, in the way they were recorded, or not recorded at all.

The current market is punishing. A transformer ordered today may not arrive for fifty weeks. Switchgear lead times have doubled. Copper moves on geopolitics as much as on fundamentals. A generator specified eighteen months ago may no longer be manufactured, or may now fall under export restrictions that did not exist when the contract was signed. Specialized commissioning engineers are booked out. Every one of these realities carries a cost, and every one of them sits somewhere in the contract, waiting to be picked up or waiting to be missed.

What separates a recoverable position from an unrecoverable one is rarely the magnitude of the impact. It is the paperwork. A contractor who issued a timely notice under the correct clause, attached the supplier correspondence, tracked the delay against the approved programme, and kept a contemporaneous record of mitigation efforts is in a fundamentally different position from one who raised the issue for the first time in a final account six months after the fact.

MEP works amplify this problem. The package is document-heavy by nature: material approvals, shop drawings, coordination drawings, manufacturer data, testing and commissioning records. When a claim arises, the same discipline that produces those submittals needs to be applied to the claim itself. Cause, effect, entitlement, quantum. Each established in its own right, each supported by the records that existed at the time.

The contracts themselves usually offer more than parties realize. Fluctuation provisions, variation mechanisms for substituted equipment, extension of time and prolongation cost entitlements, change in law, force majeure, and in some jurisdictions statutory hardship relief. Whether any of these apply, and whether they apply cleanly or with friction, is a question of drafting and evidence, not intuition.

For contractors carrying the risk of a volatile market on fixed or partially fixed pricing, the window to protect a position is narrow and closes quickly. A contract review at the right moment, followed by disciplined notices and records from that point forward, is usually the difference between a claim that settles and one that does not.
